Bruce Cabbins Distribute Ampehtamine 3-17-15According to Commonwealth’s Attorney Robert Clement, the defendant sold two capsules for $20 on October 7, 2013 in an investigation conducted by the Tri-County Narcotics Task Force under the supervision of Lunenburg Deputy Sheriff Adam Martin. Two other charges of Distribution of Cocaine were nol prossed as part of a plea agreement.  Clement said the evidence was not as strong for these two charges, and did not make much difference on the Sentencing Guidelines.  He said that Cabbins’ guidelines were much higher than usual due to the fact that the defendant had been convicted of Attempted Robbery, Conspiracy, and Use of a Firearm in Nottoway County in 2010.  Cabbins could be subject to a revocation of 15 years suspended time from the Nottoway convictions for violating the condition of good behavior, having served three years on the firearms charge.

In addition to the time he will serve on the Lunenburg conviction, the defendant will be subject to conditions of a suspended sentence of seven years and two months including good behavior for 10 years, supervised probation for one year, counseling, warrantless searches for five years, and restitution to the Virginia State Police for the “buy money” and “informant’s fees” in the amount of $320.
