Intoxicated Driver Cut Off

Billy Lee Dempsey (Felony DWI)CHARLOTTE COURT HOUSE – Billy Lee Dempsey III, a 36-year-old Charlotte Court House man of 290 White Street was convicted recently in Lunenburg Circuit Court of a felony DWI and Driving on a Suspended license. He was sentenced to five years in prison with all suspended except one year and ten months on the DWI and 30 days incarceration on the DOS. He was fined $1000, and his privilege to obtain a license was revoked indefinitely.

According to Commonwealth’s Attorney Robert Clement, the incident leading to his arrest arose on March 12, 2017 about 4:20 p.m. when State Trooper W. T. Dean II stopped Dempsey for defective exhaust.

Dempsey failed three field sobriety tests and was arrested for DWI.  His breathalyzer test revealed an alcohol level of 0.11.

Dempsey had prior felony convictions of driving under the influence in Prince Edward County in 2015 and Charlotte County in 2007.  He had misdemeanor convictions of DWI in 2000 and 2001.

In addition to his sentence and fine, Dempsey must be of good behavior for five years, complete supervised probation for one year, attend substance-abuse counseling, abstain from alcohol and illegal drugs, and submit to warrantless searches and seizures.
